1. Acceptance of Terms

By purchasing and using the tools and services provided by X Inspector Inc., you, the subscriber, agree to be bound by the terms and conditions set forth in this User Agreement. If you do not agree, please do not use our services.
 

2. Description of Services

X Inspector Inc. provides a subscription-based service for tobacco and vapour product retailers in Ontario, consisting of:

• Education & Compliance Quizzes: Unlimited access to Google Form quizzes related to compliance with the Smoke-Free Ontario Act, 2017 (SFOA).

• Data Access: Store-specific quiz completion records available to owners/managers via a unique ID login system, accessible through a Google Sheet-integrated HTML page.

• Advisory Support: Law-related assistance and support for SFOA contraventions via telephone, video conference or email.
   

3. Payment & Subscription Terms

• The service is available through a one-time annual payment of CAD $39.95.

• Payments are accepted via Interac E-Transfer through online or mobile banking.

• Subscriptions are valid for one year from the date your account is set up (typically within 1–2 business days of payment reception).

• No recurring billing; renewal must be initiated by the user.
   

4. User Responsibilities

• You and your staff are responsible for using the quiz links provided only for your registered store.

• You are responsible for using the data access link provided only for your registered store.

• You and your staff must provide accurate first and last name when using the quiz form.

• You must contact X Inspector Inc. within 24 hours of receiving a Provincial Offence Notice (PON) if seeking advisory support. Failure to do so may result in an inadequate amount of time for you and your staff to receive the necessary advice from X Inspector Inc. to adequately address the charge(s) and meet court deadlines.
   

5. Limitations of Service

• Access to quizzes and data is dependent on Google services; X Inspector Inc. is not liable for outages or inaccessibility due to server issues or downtime.

• Only publicly available information (store names and addresses), user information (first name and last initial), quiz completion dates and quiz results are collected. No other personal information is collected and stored.
   

6. Refund Policy

Refunds are only issued if:

• You contact us within 24 hours of receiving a Provincial Offence Notice, and X Inspector Inc. fails to provide an initial response in a timely manner, resulting in your inability to adequately address the charge(s) and to meet court deadlines.

No other refunds will be provided.
 

7. Disclaimer of Legal Representation

X Inspector Inc. does not offer legal representation. We are not licensed paralegals or legal counsel. Advisory services are educational and consultative in nature. If you choose to hire a paralegal or lawyer, they may consult with us at your discretion.
 

8. Limitation of Liability

X Inspector Inc. assumes no liability for:

• Any fines, penalties, or court decisions.

• Outcomes resulting from advice provided.

• Service interruptions due to third-party platforms (e.g., Google).
   

9. Termination

We reserve the right to suspend or terminate access without refund if there is evidence of abuse, fraud, or violation of this agreement.
 

10. Changes to the Agreement

We may update this agreement from time to time. Continued use of the service constitutes acceptance of the new terms.
